Your participation in our program signifies that you have read, understand and agree to the Terms of Participation as stated in this document. If you do not choose to agree to any of these terms, you must discontinue the use of this website immediately.

The terms and conditions in this document constitute the entire agreement between the parties and shall supersede any prior oral, written or electronic agreement between the parties.

If any provision of this Agreement is prohibited by law or held to be unenforceable, the remaining provisions hereof shall not be affected, and the remaining terms and conditions shall continue in full force.

This document contains references to parties which are defined here:

• The terms "we", "us", "our" and "company" refer to Casslin Data Systems LLC
• The terms "you", "your", "yourself" and "customer" refer to the customer (a person participating in our program and/or using our website)

We offer these headsets at greatly reduced prices (often free) because we feel that they can help make driving safer in situations where you must use your cell phone while driving.

Obviously we can not guarantee that using a headset will make you a better driver or aid in preventing any sort of accident, discomfort , injury or other ailment.

By participating in our free headset offer you agree that the use of a cell phone headset and any information provided by our organization will be used entirely at your own risk.

Since we can not resell headsets that have been returned (even if the the prior owner did not use the headset); all sales are considered final.

Shipping and handling fees are non-refundable.

If your headset is damaged during delivery, you agree to notify us with-in 2 days (form the date of delivery) so we can make arrangements to exchange your headset.

If you choose to send payment by check or money order and your payment is refused (NSF return, account closure, etc), you will be obligated to pay the Return Check fee in the amount of $35 USD in addition to the value of the payment itself. If we are unable to collect the balance of your returned payment with-in 30 days, we will send your invoice to an attorney and/or collection agency. If your payment has to be sent to an attorney and/or collection agency, you agree to pay all attorney and collection agency fees involved in the recovery of funds, in addition to a processing fee of $500 USD.

If you submit an order using your credit card and then execute a chargeback, you agree to pay all attorney and collection fees involved in the recovery of funds, in addition to a processing fee of $500 USD.

All chargebacks will be considered fraudulent and will be reported to your local law enforcement for prosecution to the fullest extent of the law. Fraud will not be tolerated.

All legal matters brought against the company are to be settled by arbitration in San Diego, CA USA. You agree to pay all costs involved with the arbitration process.

The maximum liability that company shall have at any time to the customer, shall be equal to the sum of all monies paid by the customer to the company.
