Terms & Conditions

Your participation in our program signifies that you have read, understand and agree to the Terms of Participation as stated in this document. If you do not agree to any of these terms stated below, you must discontinue the use of this website immediately.

The terms and conditions in this document constitute the entire agreement between the parties and shall supersede all other oral, written or electronic agreement between the parties.

This document contains references to parties which are defined here:

  • The terms "you", "your", "yourself" and "customer" refer to the customer (a person using this website and/or participating in our program)
  • The terms "we", "us", "our" and "company" refer to the FreeHeadset.org entity

We offer these headsets at greatly reduced prices (often free) because we feel that they can help make driving safer in situations where you must use your cell phone while driving.

Obviously, we can not guarantee that using a headset will make you a better driver or aid in preventing or eluding any sort of accident, discomfort, injury, medical condition, etc.

By participating in our program, you agree that the use of any cell phone headset and any information provided by our organization will be used entirely at your own risk.

Return Policy:
Since we can not resell headsets that have been returned (even if the the prior owner did not use the headset); all sales are considered final. Shipping and handling fees are non-refundable.

You ABSOLUTELY MUST allow proper time for delivery:
The standard delivery time-frame is one to eight weeks. Shipping times can vary for several reasons, such as; delivery location, order volume, product availability, payment method.

Mail Order Payments:
Mail order payments will require and additional processing time of 3 to 21 business days depending on the date we receive the payment and order volume in our system at that time.

Damaged in Transit:
If your headset is damaged during delivery, and you notify us with-in 2 days (from the date of delivery), we will be happy to exchange the damaged unit.

If you choose to send payment by money order:
If your payment is refused (NSF return, account closure, stop payment, etc) a processing fee of $250 will be billed in addition to the full payment amount. If the total due (the sum of returned payment amount, plus all applicable fees, penalties, interest and other charges) is not fully paid with-in 30 days of the date the check was returned, you will be assessed an additional processing fee and your account will be forwarded to an attorney and/or collection agency for collections. In addition to the fees listed above, you will be required to pay all attorney and/or collection agency fees billed during the process of recovering the full payment amount plus all applicable fees.

If you choose to send payment using your credit card:
You certify that you have the legal right to make charges against the credit card account you provide to us. If a chargeback is issued against your payment and/or order, you and/or the credit card account holder, will be billed a chargeback processing fee of $250 in addition to the payment amount. If the total due (the sum of returned payment amount, plus all applicable fees, penalties, interest and other charges) is not fully paid with-in 30 days of the date the check was returned, you will be assessed an additional processing fee and your account will be forwarded to an attorney and/or collection agency for collections. In addition to the fees listed above, you will be required to pay all attorney and/or collection agency fees billed during the process of recovering the full payment amount plus all applicable fees.

Arbitration:
All customer-initiated legal matters are to be settled by arbitration in San Diego, CA USA. You agree to pay all costs involved with the arbitration process.

Maximum Liability:
The maximum liability the company shall have to the customer, at anytime, shall be less than or equal to the sum of all monies paid by the customer to the company.

Additional Provisions:
If any provision of this agreement is prohibited by law or held to be unenforceable, the remaining provisions hereof shall not be affected, and the remaining terms and conditions shall continue in full force.
